COUNTERFEIT HELIX CHEESE RECALLED FROM THE MARKET
The new intellectual property law 6769 that took effect on 10th January 2017 does not allow counterfeit products. Istanbul Intellectual Law Cart applied the new law and ruled that the counterfeits of Muratbey's innovative Helix Cheese be recalled from the market as a precautionary measure.
The new Industrial Property Law came to the help of Muratbey that is putting up a major fight in Türkiye and across the world to protect Helix Cheese it has produced as a result of long R&D efforts against the counterfeiters. The new intellectual property law 6769 that took effect on 10th January 2017 does not allow counterfeit products. With the law, counterfeit designs are immediately blocked by the courts.
Lastly, Istanbul Intellectual Law Cart applied the new law and ruled that the counterfeits of Muratbey's design called Helix Cheese be recalled from the market as a precautionary measure. With this judgment, registrations made with a malicious intent and their use were expeditiously blocked. The jurisprudence of the Supreme Court that registrations with malicious intent and their use will not be protected has also been made concrete with the new law. Courts will now be able to make a judgment more effectively and quickly.
The new law will also provide a relief to the industrialists
The Chairman of Muratbey Board of Directors Necmi Erol stated that they produced Helix cheese using machines they themselves had designed and offered it to the consumers as an innovative product, and added: “When there was no law in place, counterfeit production and sales were not blocked during the long-lasting lawsuits, and moreover, counterfeit products were developing during the process. With the new law, design owners are now able to prevent counterfeit products quickly. I believe the new law will provide a great relief to the Turkish industrialists that value their R&D work.”
We work with four law firms in the country and abroad
Stating that they were aware of how wide-spread the counterfeiting and unfair competition was in Türkiye, Erol added, “some under-the-counter formations in the country and abroad have attempted to counterfeit Helix Cheese. We have put up and are still putting up a legal fight against them. All of our products including Helix Cheese are already registered. However, we protect our products with four law firms in the country and abroad in order not to give any opportunity to the counterfeiters. Our fight will continue.”
